They said the bank when under and they wont give use the title to get plates for our 2003 car. They said since the bank wont pay we have to give it back. Can they do this to me?

Jake Sweeney told me today after have the car and signing all the papers last month....that the bank went into bankruptcy today. How can they do this? If i want to give the car back after 30days they wouldnt let me!

Contact attorney so he can contact State Attorney General.

Sounds like fraud.

By law a dealership is not suppose to sell a car they have until they have possession of the title and/or it is cleared from any banking or financing institutions from the previous owner.

To do so otherwise I would consider "selling and distribution of stolen property".

If the dealership is being totally cool about it, apolgizing, giving back all of your cash invested, down payment, etc. Then I would just do as they ask. Much cheaper and less headache this way.

If you have money invested and they are not willing to return it, then do as I said before. Attorney and all.

Sadly, yes. If there is no way to arrange financing for you, then you technically do not have a contract. The contract is between you and the bank, not you and the dealer. I used to work as a Finance manager at a couple of dealerships, and this does happen. I have never personally had to do it, but at larger dealerships it happens more frequently than you know.

Yes, they can and if you don't surrender the car to them they can report it as a stolen vehicle. A bank can call a loan in default and repo the car, but a dealership that has never been paid can report it as a theft! You need to return that car.

it sounds like the bank is who screwed you over. try getting a loan from another bank and finance through them your bank was obviously good for nothing.

The car has to be paid for,did you think it was free if your bank didn`t pay.?That sounds dark to me!
