Nicotine isn't illegal (yet) because there is such a HUGE number of people who have been smoking since before the ill effects were known. Its simply impossible to suddenly make 80+ yr olds into criminals for smoking when they have been doing so for many, many years.
I am sure it doesnt hurt that the government makes great revenue from taxes on tobacco products either....

You can't compare heroine and nicotine pal, Also there would be riots if people made nicotine illegal too many people depend on it now.

The powerful tobacco lobby made it illegal for the FDA to regulate tobacco like a drug. Said it wasn't under their jurisdiction. Therefore, there was no agency to make tobacco illegal. (Nicotine itself is not that deadly - it's all the other crap that comes with it when you smoke)

Billions of dollars in lobbying Congress and legislative bodies worldwide by the tobacco companies. Heroin does not have a lobby.
