Nicotine isn't illegal (yet) because there is such a HUGE number of people who have been smoking since before the ill effects were known. Its simply impossible to suddenly make 80+ yr olds into criminals for smoking when they have been doing so for many, many years.
I am sure it doesnt hurt that the government makes great revenue from taxes on tobacco products either....

The powerful tobacco lobby made it illegal for the FDA to regulate tobacco like a drug. Said it wasn't under their jurisdiction. Therefore, there was no agency to make tobacco illegal. (Nicotine itself is not that deadly - it's all the other crap that comes with it when you smoke)
