i had a baby with a a mexican illegal alien, he's being deported in nov, if i put him on the birth certificate, can i later have my son adopted by who ever i marry with out his permission, on the grounds of abandonment? this is the second time he's been deported he knows he's screwed and can never come back. i need to know because he is all over my *** about the birth certificate!

we are no longer together, and im afraid that if i put him on there, he will kidnap him, and take him to mexico with him, any one that knows anything about mexican men, and how they are with their first borns when they are boys.

when we first got together, he told me he was legal, i left him, because i found out he wasnt, i was in no mood to have the police beating on my door looking for his dumbass, i didnt know he had been deported till after we had gotten together, and then when i found out he was doing nothing to get his papers, i said i was done,

My advice, don't put his name on the birth certificate.

It's not worth the trouble, leave the city and get away from him, so that he doesn't know your location (hence not being able to kidnap your baby).

No, once he is on the birth certificate, he has rights as a father. Consider this long and thoughtfully, if you put him on the birth certificate, the man you marry will have a very hard time adopting your baby as his own. Deported does not constitute abandonment, as he cannot help being deported. What are you doing having a baby with a guy who is illegal and getting deported anyway. You know they only really like to deport the ones with criminal records, don't you? He is on your a** about the birth certificate because he wants to use the baby to stay. Consider this well, especially if he has a criminal record, this is a life decision for you and your baby.

if you have him on the baby's birth certificate and you want a guy to adopt the baby at a later time you have to get his permission. Because he was deported and didn't abandon the child on his own will you have to get the permission first. And even though he was deported there are ways for him to come back, but it will take time depending on how many years they told him he would have to stay in Mexico before he could come back, and if he wanted to do it illegally again. There are ways to get his rights forfeited. If you really don't want him to have anything to do with the child I suggest you contact someone that deals with Custody cases and find out how you can get his rights terminated considering he was deported from the country.

Marriage certification and child birth is a big topic in America today. You are just one of hundreds of thousands with this problem or similiar type of problem. Straight people who do not legally marry many times have children. You had the opportunity but decided not too, how do y ou think the Gay citizens feel when they are begging to me made legal and you don't even take the time or feel like you need to until an innocent child is hurt over and over again.

Don t be stupid and put him on there, if he takes your child to mexico, and he is on the birth certificate, there is nothing you can do, since he in the birth certificate, my child's father is not on the birth certificate, he is an a$$ hoel, and he is american, so I did not want to deal with that, so if you find some one in the future that is good and love you and your child, and the father is not on the birth certificate, then yes he can adopt the child, now you will have to get a lawyer and state to the judge that you do not know who the father of the child

Seems like is he doesn't have legal custody over the baby, and if the baby is a citizen of the U.S and you are a U.S citizen. It makes sense that an illegal immigrant cannot touch him. Have you thought about going to a pregnancy care center in your area, and asking for legal assistance, many centers could probably hook you up with some pro bono legal counsel.

He's no dummy. He knows that if you put him on the birth certificate,he will be able to get sponsored by him in the future. Since he is illegal,he really doesn't have any rights. But your child has a right to know his real father and bear his last name.

You've kept him OFF the certificate for a reason! Listen to yourself and follow your own advice, don't put him down. Your son will know who his father his when you tell him (I assume he already knows) it doesn't have to be on a birth certificate to be a fact. Just listen to your own head. Do you really want to chance losing your child in a custody battle in Mexico?

You should contact an attorney that specializes in this type of situation. I am sure you are not the only person that has found themselves in this circumstance. You need to protect your child and you need to work with someone in the legal field that is knowledgeable on how you can do this legally. Don't wait. Do it.

That is hard to say. Are you only breaking up because he is being deported? You probably should have married him before you had a baby with him, like before you slept with him. then he could have gotten his papers and been with his child. I hope that you dont deny him seeing his child, that is cruel.
