I dont see in the visa waiver program where you waive your rights to be released from detention. Its another proceeding than deportation. and where does it say mandatory detention for overstays on visa waiver. All i see is waived rights to fight deportation or admissability at the port of entery!!

The visa waiver is exactly what it says it is: a way for the citizens of certain countries to enter the US for up to 90 days for business or tourism without having to apply for a visa. If you overstay or attempt to adjust status, then you are subject to all the rest of US immigration laws, part of which provide for the detention and deportation of people who forget to go home.
