It already is in some places and it once was in the U.S. as well. Like many things it was banned as part of an election campaign where it was made a hot button issue to get someone into office. The U.S. is behind most other industrialized first world nations on almost every social issue, but eventually we do catch up. I do believe that marijuana will be re-legalized here eventually, probably state by state the same way same-sex marriage rights are progressing.

Yes. In many states the use of medicinal marijuana is completely LEGAL while it is still illegal under federal law. In Santa Barbara, CA it takes only a doctors 'recommendation' (not a prescription) and you can walk into any one of the 5+ storefront medicinal marijuana stores in major shopping centers (some set up similar to jewelry stores) and walk out with a half-pound under state law and the eyes of the police. It is basically legal all ready. If the feds weren't able to pocket the bank accounts of the people they bust there would be no worry. Some laws are plain wrong. It also used to be illegal to free slaves or to hide Jews from the Nazis.

Yes, but not everywhere. (most) States will legalize it but leave it up to the cities whether it will be legal there, or not.

You will be able to get stoned at Hippy Hollow, but anti-smoking ordinances will keep it off the streets of Austin.
