I'll just put it to you this way: Do you honestly expect to get something for nothing? Either application is going to install 3rd party spyware/adware into your system (neither will run without it as stated in the EULA; neither will kazaa for that matter) which not only invades your privacy, it also leaves your extremely vunerable for virus attacks. Also, the spyware that is included with most p2p apps is EXTREMELY difficult to get rid of. I have seen computers that have been crippled when the user tried to remove them.
Sure, the Pro versions that some people have mentioned will allow you to run the app without the 3rd party spyware apps installed, but you still have to remember that you are downloading something from people that you do not know (I could easily create a trojan and list it on a p2p server as your favorite song. When you download what you think is your favorite song -BAM- I gotcha). Sure you can use antivirus/antispyware software to eliminate most of them, but you'll have to update your av/as software before you log onto the p2p server.
Anyhow, illegal downloading will never stop, so if you're going to do it, then do it right. Get a pro version of a p2p app and get some good protection. And make sure you're ready to battle spyware and viruses.
Or just use IRC instead.... But that's a whole different ballpark...
