My boyfriend asked a friend of his to mail me a package. I am worried that his friend said he would and didn't.

No....what a question. The "mail" isn't mail until it's in the mail box. Further, if the person doesn't do what was requested of him, it's not illegal....he's just a flaky friend.

Now, if he took it and never mailed it, it could be considered theft (class of crime depending on value of the contents) but what proof do you have?

Lesson learned for your boyfriend, if you want something done right...do it yourself...

No, since it was never mailed, and the person was given permission to be in possession of the package.

If they took it, it can be a criminal case for theft, or fraud perhaps

Plus a civil case for the value of the package

No, it is grand theft, larceny if it never was put in the mail. You need proof for the police.
