my parents live in Rochester Indiana and they have been told by both the mayor and police that they can't and won't enforce the law does he need a lawyer or is there another ave to to first?

Consider starting to take action yourself, like leaving notes on the cars saying "i'm actually disabled and today i couldn't shop because of your car being illegally parked. I wrote down your license plate and reported it to the police" Don't do anything to hurt their cars, but take action yourself to motivate them to stop doing it. Don't depend on the police to enforce the law. That will get you frustration. Wait for the people and ask them about their parking. Park behind them so when they come out they will be delayed by the fact that you are waiting for the space. You could put a card on their car that says in big letters "I violated the law and took a handicapped space, preventing a disabled person from using it" so they will be embarrassed and ashamed. Keep an open heart and keep being generous. People know they shouldn't do it. A human face and a little conversation could change their behavior for life.

I have a hard time believing that the locals wont enforce handicap parking spaces. It is federal ADA and is built into state and local laws and ordinances, and they are required to enforce them, even on private property. If the locals wont do their job, try the county or the state. Additionally, there should be some sort of state regulatory board or commission for Indiana which oversees police departments at all levels, possibly you could file a complaint with them.

If it were in Illinois, I would enforce it for you. Drivers pay high penalties and it is a must appear in court for violating handicap parking spaces and related offenses.

I have a DP permit (I'm a wheelchair user) and when I see vehicles parked in "accessible" parking spaces (that is, those marked as "reserved" for people with disabilities) without the "proper" permit or license plate, I issue "tickets" I have created, noting the date, time and license number of the offending vehicle--if someone's in the vehicle, I remind them of the law (in my state, illegal parking in DP spaces results in a $250. fine if they're caught by law enforcement).

I have also heard of some people who let the air out of the tires of any vehicles they spot that are parked illegally in DP spaces (they also leave notesn on the windshield saying "you took my space, I took your air!").

I also heard about a gent who,. upon entering a restaurant parking lot parked his van (lift-equipped, by the way!) behind two cars that were parked in the eatery's two "accessible" parking spaces (illegally, I might add!), thereby preventing them from being able to leave. He then went inside with his family and had dinner. When the two vehicle owners asked him to move his van, he refused, saying that "they took" his space, so he was "going to take his time" eating. When the vehicle owners complained to the restaurant owner, he tried to get the van's owner to move, to no avail--the van owner woiuld not budge. Eventually the police were called--the van owner wasn't cited, but the two other vehicle owners received tickets for illegal parking (with fines of $500 bucks each!).

If it is a state law have them towed at owners expense.

I KNOW WHAT THAT FEELS LIKE BECASUE I HAVE A HANDICAP CARD AND WHEN I SEE CARS WITH NO PLATE OR CARD I REPORT THEM TO THE STORE THEY ARE IN. IF I WAS YOU I WOULD CINTACT THE STATE DMV AND SEE WHAT HAPPENS.

they are a complaint driven force, you just have to complain to get it enforced.
complaining is not the same as "I mentioned it to officer bubba when i seen him" you go to the police office and file a complaint.
