I am a US citizen who got married already, so cannot use the fiance visa. I also want the immigrant visa (I-130) not the K-3. I know that takes longer, and that is ok. I wanted to know if anyone has recently done this, and how long did it take. I have heard close to 8 months. is that true? My wife is from Pakistan, and a Canadian Permenant Resident. However the process will be in pakistan, not canada, because she is living there currently.

well im a US citizen and my husband was from europe. i went there and applied for a visa for him to come and become a permanent resident. i went in May 2005, droped off the apps. we had an appoitment on july 14th and they gave him his visa on the spot. so he was able to leave then. but we wanted to have our wedding there so we stayed and by Sept 8th he was in america with me. so it didnt take that much. time goes by really fast.

There is not a set time. It is a matter of how long it takes them to process the paperwork. Obviously it is backed up in certain locations. If you are coming out of Western Europe the line is generally a little more efficient because there are fewer people trying to relocate. Pakistan, however, is probably much like Mexico, my wife's country, and it probably will take 6-8 months to get her an appointment with the U.S. embassy in Karachi, and then, it will probably be another few months before she can go and see someone. But, after that, you should be good to go. I am currently waiting for my wife as well. It's not fun...

I think you may have another option. Have you wife come here on a tourist visa and while she's here file for a green card, which she is entitled to as a wife of an American citizen.

While the application is pending your spouse can stay because the INS can't penalize you because of their own inefficiencies in processing applications.

I would recommend contacting a lawyer to come up with a legal strategy.

Yeah, a long time. It could take a year and that is why I never married my fiance in her country. She is arriving here in the US after a 5-month process.
