I filed a chargeback for a 400 euro deposit (ebay sale with an individual, not a dealer) after the seller changed the terms on a phone conversation (he told me he accepted euros, then he wanted me to cover the exchange rate fees). I'm still interested in the bike at the original price and sent a letter to the seller by recorded mail regarding this issue. I think he is taking legal action. I didn't sign anything and all it's been done through email. I think it's important to state that I'm based in Barcelona and the seller is based in wales. What would you recommend? Am I in big sh*t? Get legal advice from your solicitor is the best thing! Depends how you filed the chargeback though, if it was done legitimately through PayPal or your card company then you should be fine especially if the conditions were being changed verbally which you disagreed with. If you have signed anything, I would certainly have a read through & see what you have agreed to.

All in all, I would say never buy a bike from abroad, least of all through eBay! But in any case seen as it was only through eBay I wouldn't worry too much, worse case you'll lose your eBay/PayPal account or have to repay the guy at least the deposit. Best to consult a solicitor though just in case he does take this matter further though - might wreck your credit history!

I'd say that it sounds as if the seller has changed the terms of the sale. That would be an entirely valid reason for backing out and charging back the deposit. I wouldn't reckon he'd be trying legal action in another counrty over 400 €.

I'd be walking away from the deal. Nor would I buy a motor vehicle from a foreign seller -- too many potential pitfalls, as you are learning.
