For example.. If, to be able to return to the US, you have to either have a full time job or own a piece of land, and for some reason you cannot do either, will you be banned forever? Can the requirements be waived?

There are no such requirements for immigration to the US. If you're talking about not being able to qualify for a /us tourist visa, then just getting a job or buying a house in your own country won't work either. The interviewing officer needs to be convinced that you intend to visit the US for a short time and then return home. If you can't convince him or her of that, the law says your application must be refused.

Depending on what country you are from there is a lottery for a green card, or you can apply under normal quotas. It can take a long time though, because we subsidize education and services for poor people legally here, and a lot of them want to come. We do allow some though, unlike many countries. It is just a long line, and with the current number of illegal immigrants we have here, people aren't keen on raising the quota.

Stay tuned though, because the debate rages as we speak. If I were you I'd apply now though.

People are not "banned" from returning to the US unless they were deported in the first place. Visa violations usually carry a penalty of 10 years. After that you can reapply like everyone else, and wait like everyone else. Why were you banned in the first place?
