On 30 May of 2005, I was assaulted and battered by my spouse who is a senior officer in the military, I filed an injunction against him, but I had no support from the base legal systems, his commander, nor the local government agencies for the assault. In fact, my husband was advised by his commander to file for a divorce the day after the assault occured. This made things very difficult for me. The base housing was pressuring me to move out of the residence, with no money, no support, I ended up asking the judge to withdraw the injunction. I got back with the abusive husband and the emotional, verbal and economic abused continued. Can I retract and file charges against him now on the assault that occured the year before? Left the husband and now completely abandoned by the system and the military.

I know what you mean about dealing with the misoginist pigs in high positions in the military, esp. the Marines. My answer is to put the past behind you and divorce the bum, if you have not already done so. Go back to school so you can support yourself, and get some councelling to find out how to choose a winner next time, instead of an abuser. One thing I've learned is to never speak of the abuser you just dumped. It lets other abusers know what you are willing to put up with. NEVER move in with or marry a man until you have been dating him for over a year and know all his friends and family. If he comes from a house where his mother was beaten by his father, shake the dust from your feet and run like hell in the other direction. Yes, people can learn to change, but you are not required to be the punching bag during the learning period. Best wishes for a better tomorrow.

Ignore whoever said "love to hear the other side" cause they are an idiot!!!
You need to get your own attorney right away. The military take care of their own, you need to take care of yourself. Get an attorney immediately! If you don't know how, call the local bar association in your area which usually can be found in the phone book. Ask them for a recommendation based on the problems you are having. They should give you a list of attorneys who handle this sort of case.

This is very difficult to answer. What do you want? Do you want to go back and do this, or move on? If its over, I'd move on. I feel your going to bang your head against a wall, unfortunately he is protected and he's done what he wanted. Why you would get back with an abusive spouse I have no idea, but this is definitely not going to work in your favor as a defense. My best advice is if you tried your best in this marriage, just be happy with you did and that you tried and move on. This seems mostly like a form of revenge and you need to get on with your life.

Depending on the state, I think it's usually 1 year but I could be wrong.

I really can't believe that the military would do this to you. Get yourself a good lawyer and go through the civil courts of your state.
