My sister has a body warrant out for her arrest, and being she has a son, she needs to know how much time she should prepare for to take off of work and whatnot...

That's why I'm asking, so she knows when would be best to go and turn herself in as far as daycare and work goes...

What she should do is turn herself in. You watch her kids if she has any. It doesn't go over well in court when you know there is a warrant out for your arrest, and you do nothing about it.

An arrest warrant generally issues when the police have probable cause to believe you committed a crime of such a nature that you are either a danger to the public or you will not appear in court to answer the charge. A bench warrant generally issues when a person who was summonsed to appear in court for some purpose (either because they were summonsed to appear for an arraignment, or were scheduled for a hearing and failed to appear, or were ordered to do jury service and did not show up). The judge issues a warrant from the bench allowing you to be arrested. Both warrants give permission for the police to detain you in custody until you appear before the court at the next opportunity. You might be able to get bailed out, depending on a number of factors--unless the judge has issued a non-bailable warrant, or the bail amount is so high you can't raise it; in which case you're stuck in jail until you get in front of the judge.

An arrest warrant means you have been charged with a crime. A bench warrant means the Judge has enough evidence without the District Attorney presenting evidence to have you arrested. And in the case of failure to appear for Jury Duty, the Police or Sheriff, whichever has jurisdiction may well come find you. When I was called for Jury Duty the Judge issued several Warrants. And most of those people did show up the next day.

A BODY warrant means that the officers are seeking an individual and, therefore, cannot search drawers and places not large enough for an individual to hide.

A SEARCH warrant allows officers to search all places in which the items listed on the warrant can be hidden.

She needs to turn herself in. It is the best thing.......

I believe you can go try and explain what happen. You still get to have a hearing to see if the warrant is right. Can't you go pay the warrant and get new court date? Try calling a criminla lawyer and asking them what you should do....good luck

She will go straight to prison for no less then a year.
