It depends on what issue,. anyone can sue anybody.
but if you say undocumented worker.
You can forget worker . He is already undocumented.
If you mean because he's being called names and or mistreated because of his race.
then yes.
But he'd have to prove it in such a way that it's been an on going thing for sometime W/ proof and/or witnesses,times dates, etc.
It's a difficult thing for your friend., but things do happen. And it's not right.
sometimes it's better to forget about it and find another place where his hard work is appeicated. regardless of who he is, and regardless of what anybody says . YOU CAN SUE>
weather your here illegal or not . the Law applies to everyone and were all protected by the constitution of these united states made up of immigrants.

Here in Arizona a court recently ruled that NO illegal can sue for punitive damages. I am in total agreement with that ruling. it will not be over turned. Slander is a civil case, illegally entering the United states is a federal case. I would love to see such a case go in front of a judge and have the illegal handcuffed and be arrested.
Not to mention...don't you think it would be a little hypocritical for a person to break American law and then try to find a way profit from it?

You can't sue if you aren't a citizen. And you have to be able prove damages to collect for slander. Just go home and cause problems there.
