hello a friend got pulled over last week (for a traffic violation) and they found approx 20 estacy pills on him. they said they assumed he had drugs on him and wanted to search the car. he had just purchased them and was basically bringing them home. however the cops are trying to charge him with 'trafficking a controlled substance'. how can he prove that he was hooked on the pills and maybe get diversion or something? he has never had any prior offenses or been in any trouble. he is willing to do a drug program or something like that.

It's all about money and your friend is about to part with everything he's got. That's just the start. The taxpayers are about to get raped big time. Some shyster lawyer who gives big kick backs will get appointed to the case and do nothing but cash a check. Jails are pretty full right now so a drug program and probation after they reduce the charges.

In many states ( assuming USA) state laws are even specific that merely possession of certain drugs at certain amounts are automaticly possession with intent, since that amount would normally only be for dealers.
So a good lawyer is the first thing he needs.
next if he will give up his supplier ( which is what they most likely really want anyway) he could most likely make a deal for a much lesser crime

if they were all in one container and not divided up into several, has can successfully argue that in fact they were for personal use, this will be done by his atty. and the prosecutor, in some sort of plea deal. Also he should prob start treatment immediately because that will look far better then having to force him. and with no prior record his sentence will likely be relatively light, he may not however get away with simply entering rehab.

With that many pills it is assumed that he was trying to sell them. Don't think he has much of a chance other than to plead guilty and take the punishment. But hire an attorney.

ok let me make you feel better...i knew a friend who was stopped in a car with 27 pills on him. he went to prison for 7 years for dealing them..even though he pleaded it was for personal use only. there aint no way out. even if he tells his lawyer/solicitor it was for him self it depends on the judge and believe me they dont take this lightly any more because of the amount of people that have died on over dose. any way go with the flow and if it is a friend and not you just be there for them during the sentence.

Sorry but in most states there is a set amount that they consider for personal use and anything above that is considered to be intent. He needs to speak with an attorney and find out what his options are.

Let him go to jail and "dry out". It will be the best thing for him, to find out that, in the "cross bar" hotel, it aint no picnic and he should have a "severe wake up call", right about NOW!!
Get off the pills!! Going to Jail might be the best thing for him and when he gets out, you may want to help him stay "clean".

two words, Plea Bargain, try and get the trafficking charge dropped to simple possesion thats the best way to stay out of jail
