I am not the father I am the fathers wife and we have heard numerous times that the mother is still claiming my husband as the father even with the DNA test. ITS NOT FAIR TO MY HUSBAND for this little girl to think he just abandoned her either?

You can name yourself and the child anything they want unfortunately. If he has a DNA test proving he isnt the father and is not being forced to pay child support then just stay away from those people. However if he was raising this child for years as his own then it doesnt matter that he isnt the biological father, because the child views him as their dad then that will never change for the child. You cant force a name change. If your husband wants nothing to do with the child and the mother then just stay away from them. Cut all contact. Move if you have to.

THEY HAVE IT SETUP AN OLD ENGLISH LAW STILL ON THE BOOKS.BY ASSOCIATION WITH THE WOMAN YOU ARE BY BOUND BY LAW.IF SHE KNOW YOUR NAME,SSN.,AND WHERE YOU LIVE ALL SHE HAS TO DO IS NAME U THE FATHER AND U ARE GUILTY.YOU HAVE TO PROVE U ARE NOT BY DNA,IN THE MEAN TIME YOU WILL PAY AND MOST CASES IF YOU PAY OVER A YEAR AND FIND OUT ITS NOT YOURS.YOU MAYBE ORDER MY THE COURTS TO STILL PAY.FIND OUT ITS NOT YOURS AFTER PAYING NO REFUND,NOTHING HAPPENS TO HER, NOTHING BUT SORRY MY BAD THIS SUCK FOR ALL MEN BECAUSE WOMEN HAS THE POWER AND SOME STATES BACK THEM UP RIGHT OR WRONG THIS IS NOT FAIR TO ANYONE SO GIVEUP THE BANDADE AND GET THE RIGHT LAST NAME FOR YOUR KIDS AND THEY CAN TAKE PRIDE IN THAT

I know that in the state of New Jersey, you are allowed to give your child ANY last name upon their birth, withstanding curse words and numbers. I think it is safe to assume that many states allow this.
Perhaps the mother cannot afford to change it?
Have you considered offering her the money it would cost, since it seems that important to you and your husband to not have his name associated?

Research with the law governing the state you are living in and find out if thats even legal. It has to be proven and consensual to do that, I suppose. So, you have a strong case to disprove it (DNA tests as well).

Is the child THAT bad, that you don't want them to have your last name? How do you explain to a 7 year old that they have to change their last name? "Mommy doesn't know who the father is?" Do you think that anyone with the same last name as you is related to you? Give the kid a break, he obviously needs one.
