i read an article one time that a phone s*x operator had gotten carpel tunnel and sued the company she worked for saying she had gotten it from masterbating too much, she won and got lots of millions!!

You can sue anyone at anytime, whether you have a case or not is to be determined. Guess you have to decide whether it's worth the money to get a lawyer and pay the consultation fee to find out.
