I was bit by my neighbors dog and I sued the owners and lost the case (Long Story) . My question is the dog is who bit me so can I sue the dog and if I win the dogs owners have to pay because they are its caretakers. Can I sue this animal in a court of law?

And what would the grounds be for the lawsuit? You didn't say where you were when the dog bit you in the first place. Were you in the dogs yard or did the dog trespass on your property and bite you? Are there leash laws where you are? You can not sue an animal other then a human. You can sue the owner of the animal but you have already done that and lost the case so unless you can show where the animal is vicious or the owner is negligent you don't have a leg to stand on and sounds to me like if you don't keep away from the dog you might not even have that much longer.

No animals have court impunity, unless biting someone is a recurring habit. Also you could be charged with contempt of court, and sueing the same people twice for the same thing (double jepordy which is outlawed in the Constitution), because the owners would represent the dog seeing as you could'nt actually sue the dog. And you'll almost definitely be laughed out of the courthouse.If it happens again call the animal police in your area. Or you could take the case to a higher court.

My first question would be what did you do to piss off the dog, the second question I'm going to ask is, what is your preoccupation with suing others? Are you trying to walk off with a big payday? Personally I'm sick of seeing the number of lawsuits these days, people sue one another for every reason imaginable, and quite a few I can't even conceive of how they made it into court. I think lawyers as a whole need to stand up and start telling people that they need to quit whining like a bunch of maggots and get on with living. A dogbite is not a reason to sue another person unless you suffered grave physical injury, and I won't even get into my disgust with suing for emotional distress and other psychological trauma.

I don't think that you can involve an animal in litigation. Even if you won, how would you get compensation? You have to go after the dog's owner, or if there is none, you may be able to sue the city.

Even if you could sue the dog, which you can't, why would you think you could be successful against a dog when you lost the case agaisnt the owners?

A dog is considered as property in the eyes of the law. You cannot sue property only the owner of the property.

you cant sue the dog, just the owners. when i was bit by my neighbors dog animal control took him for a week to see if he had rabies, and i convinced them to keep him longer. i would suggest trying to take them to small claims court for emotional damage, and if there was a doctors bill, that too. maybe youll win something

If you have already lost the case against the owners the same evidence would probably result in a loss against the dog. If you still have all your fingers, toes and body functions, I suggest "let it go" and chalk it up as a learning experience.

No you can only sue, because of negligence. The dog is under their control. It is kind of like a kid, when a kid does something wrong the parents are usually held liable!!! My question to you is what did you do to make that dog bite you in the first place!!
