You need to get your terminology straight. If the person is undocumented then he isn't a legal resident. If you are talking about an illegal, then no, he has no right to sue but as we can now see, everything is possible since our present administration doesn't consider being "undocumented " as breaking the law just a small technicality.

As for your ? YES any person has the right to sue another for an illegal action, no matter what their status is in the COUNTRY the illegal action took place.
They can always deal with that country's immigration policy after they have their day in court or a settlement is reached by both parties involved.
