Not everything is fair. For example; you're not even from America and can hardly speak English, but yet you're trying to get advice from an American standpoint on a legal matter. I think you should have reported that when it happened to the police. You're obviously not in too bad of shape or you wouldn't be on the computer asking people about it.

Did it actually hit you or did you fall over to avoid being hit? Makes a difference. Were there witnesses? Did you get the info. from them? Did you report it to the authorities or the driver? If the answer is no, they have no responsibility.
