the couple have been together for 22 years but do not meet the criterias for comman-law marriage.They live on the mans parents property in a garage made into a house.Everything is still in his parents name.they have decided to call it quits but she is refusing to leave the garage(house).Can she be made to leave and what steps can you take in seeing her out?She has children she can go and stay with,it's not like she has no where to go.She is 75 years old(yeah 75)acting like a child.I need legal answers so i can have something to fight with and the proof to back it.It is not fair that the man had to leave his parents property and she gets to stay.

Legally she does not have to go. The owner/Landlord of the property has to get a motion of eviction and she has to be served with it before she has to go. The law states that if a person has as much as a toothbrush on the property they are legally living at the establishment.

If there is no common law marriage, she has no legal rights to be there. Even if they were legally married, the property belongs to the parents and they can kick her out. A spouse has no legal rights to anything owned by their in-laws.

She's 75 and living at her boyfriends parents house. Good lord, how old are his parents. Maybe a retirement home might be a solution.

If she does not meet common law status, and she has no lease, she is there at his invite, and when told to leave she must, otherwise she is trespassing and can be charged as such. Tragic situation, but the law is the law.
