no, he legally cannot because he is not a legal immigrant to the US of A and he doesn't have the rights because he is an illegal alien. If he was a citizen he would have the rights and then he could, no he couldn't if he is illegal.

Yes, an illegal alien can file charges against you and the police would most likely follow up on the charge. Laws are made describing activities that are against the law; not to whom it is and isn't legal to harm with those activities.
I typed "likely" as some police may overlook the issue, depending upon their prejudices, but police who "follow the book" would pursue the matter.
This does not, of course, stop you from going to the INS and reporting that the person you hit is an illegal alien. Some people might even mention to the person that this would be happening if they went to the police...

Why did you hit him in the first place? Just because he is not documented? You deserve jail time for assault. That's the criminal side. On the civil side, yes, the man can sue you. Even if he's later deported, he can openly come back as a tourist with a passport, retain a lawyer and sue you for damages. Learn the lesson.

What a sad person you must be Is that how you treat your family too strike out if you dont like something why dont you do something constructive like live and work in mexico and see if you can survive there.
There not harming any one and making a living like any one else here.
In a few months or years there papers will be in order and this will be forgotten

Any Illegal can file charges if you hit them and should, but probably wouldn't. However, I think the illegal should hit you back and would.

Anybody can sue for any reason. Whether he is able to do so depends on how hard you hit him (or her) and with what and since is in undoubtedly in self-defense you have nothing to worry about.

Yes, domestic assult is a crime no matter who the victim is. And, besides didn't your mother teach you it is a bad thing to hit, unless you are defending yourself.
