Obviously the designer has not taken up the responsibilities of creating the site and putting it up. I'd take him/her to court, for getting a refund, or bug him/her a lot about getting a refund. Honestly I wouldn't expect a good website to take more than two and a half months max. And that's if it's something fancy. In the future don't pay more than half up front, it at least gives the possible cons incentive to finish the job and get the rest of the payment.

I'm a web designer and I would be ashamed if I made a customer wait 2 years to get nothing.

If your designer has provided you with some amount of work, he should be paid for whatever portion of the site has been designed.

In the future, when contracting a designer, make sure that the contract stipulates what the site will consist of, the number of revisions to the design that are included in the rate estimate, and never, ever, pay for work upfront. You may be asked to put down a small deposit, but money should be paid only when target dates are met and actual work has been delivered.
