You can either file "Married, jointly" or "Married Filing Separately."
You probably also need to learn about the "Innocent Spouse Rule" if your husband will not sign the tax return.

You can choose "Married filing seperately." From my experience it is more beneficial for about 90-95% of married couples to file jointly. However if there is some reason for your husband to not sign, it will probably be in your best interest to file seperately.

No, you do not have to file joint... you can file on your own... ask your tax preparer!
