On May 3, U.S. District Court Judge Gordon Thompson Jr. ruled that the cross must be removed from its current perch atop a La Jolla hillside within 90 days or face a fine of $5,000 a day. In his motion to enforce an injunction originally issued in 1991, Judge Thompson wrote the presence of "a Latin cross" on public land violates the no-preference clause of the California Constitution.

Well, I see a cross. A cross is supposed to symbolize how Christ died for humanity. So, yes?

Is this a trick question?

Alright, I'll bite. Yes, there's a cross there, but it does look a bit odd. Out of proportion maybe? So what, is it actually a sword, not a cross, is that the catch, or what?

Edit: Ahh, gotcha. Don't see your point, though. Bitching about seperation of church and state, are we? It's as good an idea now as when it was first conceived. Possibly better. I wish there were more of it, myself.

Yes
The traditional form of the Christian cross is known as the Latin cross.
This judge was racist in making that statement.
He should be petitioned and removed from his duties.

I almost missed it! But using my high-resolution software, I made out that one of the roof tiles has a fuzzy inscription etched on it that reads something like " ...save at ... First Fed ...." This is obviosly a reference to our Lord Jesus and the miracle of the fish and loaves.
