Pro-Abortionists tend to view the child in the womb as a human person ONLY IF they want the child. So the question tends to be, was the child wanted. Also typically, prosecutors will charge for double murder only if the child was wanted.
The double murder charge is seen as a means for promoting and getting into law and judicial rulings the thought that the child in the womb is a human being and thus has rights under the law. Some Pro-Abortionists will not charge a double murder because they know that each and every such case and conviction only bolsters the Pro-Lifers cause for establishing legal precedence.
It really comes down to a child being considered human if he is wanted. It is of note that in Europe there have been cases and laws stating that it is ok to kill a born child if they are not wanted because the lack of want deprives them of having human rights. The same case is made for the elderly (euthanasia) where by their rights are determined by how much value they have to other people.

First off, it's not the husband who presses charges in a case like that. It's the prosecutor's office. You can't say "I don't care that she's dead." It goes forward regardless of his feelings or beliefs and the prosecutor's office sets the charges.
He can choose not to bring a CIVIL case (like OJ lost at) against the killer.

Yes. If she was still pregnant, they probably wanted to have a child. If not, she would have already had the abortion and this would be a non-issue.
