Consular officers in every foreign post are required to accept visa applications from anyone who chooses to apply, regardless of which country they're from. Sometimes it can be best to apply in your own country if your case is complex, because the officers there will have the most experience with situations like yours. You especially, because it will be your first H1B, should apply in India. But you MAY apply anywhere.
