It's still statutory rape. There have even been cases tried and won where both parties are under age 18, but one is still older, and the parents have pursued the case and won.

Once again it depends on where you live. In the state of Florida we have a statute called Sexual Activity With Certain Minors Prohibited. The statute states that an individual older than 23 (it could be 24, I'd have to look) who has sexual intercourse with a person 16 or 17 years of age commits a felony. Intercourse with anyone less than 16 would be considered sexual battery (as Florida does not have a statutory rape law). And to throw another wrench into the matter: An individual 21 years of age or older who impregnates an individual less than 18 years of age commits the offense of child abuse.
So.. IF you were in FLORIDA, you'd be OK. But once again it depends on where you live.

Depends on the state. In most states, the age of consent is 17. Therefore, if you're under the legal age of consent, and the person you're with is over that age, that person is technically committing a crime.

I am not sure what the laws are in PA, but in some states this would be statutory rape. You and your bf should check the local laws. Also, you may want to talk to your parents. Typically, in statutory rape cases the parents are the ones who press charges, so if your parents are ok with it, then you will be fine, but if not, you could get your bf in a lot of trouble.
Be careful

I read recently where a common law marriage is allowed, that the girl can be as young as 14 and there is parental consent, there is no crime, even if the guy is 40

Check with your state.
My brother's friend got in trouble because he was 19 and she was 17.
Her parents did not like him much so they reported him, and he got statutory rape. And will forever be on the sexual offenders list

It varies state to state. Most states the line is a four year difference for minors. Therefore no crime.against state law.
Morally however...

yes, and if your parents or anyone else wants to say something to the police they can, and then the person thats over age will be marked as a sex offender, and have to register for a long time.
