a sex crime can only be expunged if the crime was proved to be false and the victim recanted her statement and the DA feels there is and wasnt a sexual threat. Your lawyer would then have to file a motion to have a judge look at the matter and make a descision on the info at hand. Doesnt mean it will or wont but its up to a judge

I think you mean 'expunged from your record'. It only goes away automatically if you were under 18 and tried as a juvenile, or new evidence is found to show you are innocent and another person is guilty.
