OK this wont be a short answer since there are two issues here.
1. The marriage is completely allowed while here on a tourist Visa but when filing for the I-485 adjustment of status, you may have some issues with the Immigration office. The worst case is they make the person return to their home country and await an approved k-3 visa. Not what you want to hear, I know...but something to prepare for if it comes to that.
2. Working, an immigrant needs a work permission or Employment Authorization Card to legally hold a job. To get the work permission the immigrant must be here on a work visa or another acceptable status-tourism is not one of those, best I can tell. If you marry and apply for the I-485 Adjustment of Status you can also apply for the work permission at the same time. Its pricey with all the forms and medical exam as required so plan your financial costs early.
Immigration does look hard at people who "trick" the system. It doesn't mean they get kicked out of the country. The Life Act ensures that is not the case. But you may face some separation time in the process of truing things up.

Assuming your fiance is a US Citizen, while it's permitted to get married, if you intend to stay in this country after you're married, it may not be the wisest choice or quickest path to be together to marry on a tourist visa. You could get married on the tourist visa, return home, and the apply for a K3 visa after you're married if you wanted to live together in the USA. Alternatively, you could stay for 90 days, return home and apply for a K1 visa, if you wanted to live together in the US. A K3 is used after a couple has already married, a K1 is a "fiance visa"-the couple goees through the application process from two different countries, and then, once the K1 visa is issued, you have 6 months to come to the USA, and then 90 days followig your arrival to get married, and adjust your status. If your fiance is not a US citizen, and you just want to get married in the US to your partner, the marriage laws will vary from state to state. Note that marriage to a US citizen is not a guarantee to a green card, though it does significantly simplify the process.

The problem with the tourist visa is that the USCIS can require here to go back to her country. The K1 FIANCEE VISA is the only proper visa for her to use to enter the U.S. for the purpose of marriage. If she enters the US on another type of visa or visa waiver you can certainly legally marry her. However, she will then need to depart the U.S., obtain a K3 spousal visa at the U.S. Consulate in her country of residence and reenter the U.S. on the K3 visa in order to be able to remain in the U.S. permanently as your spouse.

he cant, they will kick him out for lying about his visa claiming to be a tourist. you are a fool to marry a guy using you just to live in the US. You would think with all the abuse that has happened with such marriages you would catch on to the scam, sucker born every minute

That is a tough one. However I have always heard that if you get married in the United States or have a baby in the United States then that makes you an automatic citizen. I do not know how much truth there is to that. There must be some truth to it if you really look around.

tourist visa is not valid for working, that is a different visa, talk to immigration about filling out the proper forms.

"tourist" a visitor to a place..staying temporarily then returning to his homeland. unfortunately many have taken advantage of the lapses in our government thus making them illegal immigrants. don't be in such a rush to get married that you break the law. jail is not a honeymoon destination.

cant you go to him? it would be much easier.
and if you do go, make sure you get a marriage licence that is accepted in your country, the U.S. doesnt recognize most marriages done outside of it's borders.
