My daughter works in a shop and she wasn't feeling well being sick but the company told her to go upstairs out the way of customers, but wouldn't let her go home !!

I wouldnt have thought so. Its up to the employee to make the decision as to wether they are ill enough to go home. I cant imagine a company would force a sick person to stay - what if it was something serious? They could be liable for any problems, so I dont think they can force her to stay.

That doesn't sound right unless the company is worried about her driving or something. Normally a company will arrange a coworker to drive them home or to the hospital if they are that bad. In any job I have had no one has ever said a worker could not leave due to illness. Some bosses are tougher than others but truly if she is sick and it is noticeable then they should let her go and I believe they can ask for a doctors note after a certain amount of days depending on their contract or rules of work.

The answer is not simple because each state has different laws. In most states they can ask here to stay but if she leaves and gets a doctors note they can not terminate her employment. I she leaves and does not get or have a doctors note they can terminate her employment, but as i said each state is different.

I think they are breaking some role!!! if you are sick you are sick and you must be allowed to go home.

She has the right to walkout I think, but then must get checked by a doctor to have a medical report!!

I hope she get's better

No...your daughter is free to leave when she thinks it is best...however, there are consequences....like losing her job/reprimand/suspension/letter in file.

It's a shame, but managers are used to young employees taking advantage and not being responsible at work...

Until your daughter demonstrates that she is not like all the other less than stellar employees, management will assume she is.
