I was involved in an auto accident where the other driver was at fault. There insurance has offered to pay for all the repairs. Now I want to file a claim for bodily or personal injury for me and my wife as we were both in the car. How do I file it and how much should I ask for?

Seek a personal accident lawyer who specializes in this type of accident. You will urged to visit a doctor to validate any proof of injury. Do not wait, the longer you do the harer it will become to seek a settlement. Have all your info and the other drivers info ready including the accident report when you speak with your lawyer. Consultations are free, the fee is 1/3 of the settlemnt which can take up to 2 years to see. So save all the medical bills and all the info. You will need it all. As far as the amount, you can settle for the maximum of his insurance allows, if you need to go to a court to determine settlement it can go higher. It all depends on how badly you or your wife have become injured, how long you were both out of work, and how many doctor bills were accrued as well.

If you didn't get hurt leave it alone..

Thats why we pay so much for insurance, people claiming for something that never happened just for the buck..

If you did get hurt get a Lawyer/...

First, you have to check with YOUR insurance company to understand whether you have a "limited tort" or "full tort" option on YOUR policy. Having a limited tort option significantly reduces (puts a ceiling on) your recovery.

Talk with a laywer and ask them to handle the situation. It would be best when it is time for you to go to court for the lawsuit.
