I bought a 97 firebird from a dealer for $5,500 cash in december of 05' its now june of 06, and they still dont have the title to give me and i wonder is that legal or should i be able to get my money back? I can't get plates without it and i was on temporary tags for 4 months and now on dealer plates for going on almost 3 months can any help me PLEASE

No, a dealer cannot legally sell a vehicle without a title. You should neither accept delivery nor hand over any funds until you have a title in hand.

You should make a demand of the dealership, in writing, to either supply a valid title forthwith or refund all monies paid by you immediately.

You should also provide a copy of this demand letter to your state DMV and Attorney General's office and file complaints against the dealer with the DMV and AG.

You may also wish to consult with an attorney.

Contact the state DMV office. They should have a dealer licensing department, and that is where to file the complaint They will be able to either get you all your money back, or the dealer will have to produce the title.

There is something very wrong with this situation. The dealer never should have sold the vehicle without title in hand!

Bostonianinmo has one point that is not correct in most states when dealing with a licensed dealership. Usually the dealership keeps the titles locked away, sometimes only having a copy on the premises. They will not give you the title in hand, because they are responsible for filing liens, and making sure that the vehicle is titled and taxes paid on time. You want to get the title in hand from a private seller, but not from a dealer!

It sounds like something you would have to take up in civil court. I have to wonder if they even had the title to begin with and if they didn't and sold the car without a title, they could get into some serious trouble.

no the dealer must have a title for every car they sell
contact the courts or a lawyer or you may never get tags for the car

Of course they are liable. First try to get them to take the car back. If not...take them to court. Small claims court is inexpensive and easy...no lawyer necessary.
They have a limit though which may or may not cover $5500.

Judge Judy will happily resolve this for you.

I was sold a vehicle 7 months ago just to find out they didnt have ownership until 2 months after purchasing vehicle
