No charges! Unbelieveable!

So if somebody molests a child, Its upto the parents to press charges? The child is not even human? OMG..

The world is really currupt and evil.

If i was the social worker I would have killed him myself.

Please go slap whoever told you that....if there is proof that the child (no matter what its age) is being abused in any way shape or form, both parents can be charged. even if only one is doin the molesting.

It is NOT legal, in any way, for someone to molest a child under 6 (or over 6, for that matter...)

Now, whether the punishment fits the crime is another matter, in my opinion.

However, regardless of the child's age, the charges aren't pressed by the parents, they are pressed by the State, and the parents don't have any say in the matter (except for when it's one parent or the other that comes forward saying their child has been molested, but even then it's up to the State to press charges, that's just more a matter of how cooperative the parents are going to be about it.)

Any legal actions the parents might pursue would be a civil suit.

Also, in most cases, the court will appoint a lawyer to represent the child's interests, seperate from the parents, even if the parent(s) are not the offender. (Again, how well they preform their jobs can be an issue...)

So, it's not a matter of it being legal or not, and who will pursue it, but it's more a matter of whether or not the legal system will adequately punish the offender, but all too often, they get away with just a slap on the wrist, because, after all, children don't vote or pay taxes, so they aren't as important to elected officials as they should be.

The state or the nation is the "parens patria" that is the state is responsible for its citizens especially minors and when they are abused they take the child away by their Social Services Division and then the justice division will file charges against the parent or the abuser and the parent if they aided and abetted and covered-up.

The only ones above the law are the priests and nuns of the powerful and wealthy Catholic Church, you can read almost everyday in the local newspapers. They are covering up sexual predators to protect the wealth of the Church. The problem that was uncovered ten years ago is still a BIG PROBLEM. But then the Catholic Church does not care for the little boys and girls that their clergy used as sexual toys. And are still using in the USA but more freely in the rest of the world where the Catholic Church has the wealth, 90% of the population are Catholics and they even control the government educational system as they do in Venezuela. Spain, and most countries in Latin America.

I'm not sure of the whole situation, but legally a spouse doesn't have to testify against you so....but I'm pretty sure that if the state was made aware of the situation they are legally bound to intervine and remove the children while an investigation is held on their behalf. Molestation of any child is illegal! I have followed stories of parents that were convicted of this on thier 1 month old child. I hope Washington state becomes the first state to put them away on the first conviction for life. Let the inmates take care of them on the inside.

In the state of Indiana, it doesn't matter who molests a child, that person is getting charged. The fact that the perpetrator was in a position of responsibility over the child, that would be an aggravating circumstance meaning that once the conviction is reached, the judge would have to consider imposing a harsher sentence.

That's nonsense. Up to the legal age, a child is considered in care of the state. So the state presses charges not the parents.

No. That's absolutely untrue. If the parents are molesting the child or allowing for it to happen they would be charged. Especially so for a younger minor.

I reside in Texas. They exercise the death penalty more than any other state in the nation. And if they find me guilty and sentence me to death for my actions... I would say so be it, lets get on with it right now.
