I am married and have been for almost 5 years my daughters Bio Father is not a active part in her life nor does he pay any child support that has been ordered, I was wondering if anyone has heard of a step parent guardianship in case anything happens to me? If anything happened to me I would like my husband to keep my daughter and raise her with her brother. What can I do?

Have you thought about your husband adopting the kids? You would have to get your ex to give him permission too, but if he did he would basically be handing over all rights to the kids and wouldn't have anything to do with them. Which sounds like he doesn't want to have anything to do with them so it wouldn't change anything other than their stepdad having custody of them along with you.

he will be a step father, yet with out parental rights. The ex husband continues to be the daddy of the youngsters and nevertheless has parental rights except he signed them away. the mother grants the step father restricted guardianship to act in the most appropriate interest of the baby(s) until eventually she or the delivery father will be reached. A guardianship, supplies someone parental rights in the absence of the mothers and fathers and counting on the circumstances, will be non everlasting or until eventually the minor is of felony age.

Only way is if your husband adopts her which involves getting her father to either sign over his rights or having a court terminate them. Good Luck.

I think if your husband adopts your daughter she would be able to stay with him if anything happened to you. The fact that he has never shown any interest or responsibilty would make it less likely they would take her away. She would also be staying with her brother, and she sees your husband as her dad.
