no but the police now try to get around it by citing "probable cause" and a lot of courts are letting them get away with this crap. Any lawyer that is worth a damn would challenge any of these type of warrant-less searches all the way up to the supreme court if necessary

There are several ways they can, but without an immediate reason they need a warrant. It all depends on the scenario.

No! I saw a program the other night, and they said that you don't have to let an officer go through your car if you don't want them to. They can only search your car if they see something that gives them probable cause. You can say NO when they ask if you mind if they seached your car. I'm sure they'll make life difficult for you for a while if you do say no, but at least you have the right.

If something is in plain sight, it isn't considered searching - or if they have cause to believe that someone is in fear for their life, I believe they can come into a home without a warrant.

In most cases, no it isn't, but there are areas such as probable cause that they can search without a warrant legally.

no it is not OK but what can you do ,

under the new terrorist act the police can do what they like ,
whether it is ok or not

USA is becoming a police state ,
and you will only get into more trouble if you complain about it.

unless they go for G bear ,then its the cops who are in trouble

Yes, probable cause. If a cop pulls you over and you have a joint hanging out of your mouth he can pull you out and search your vehicle because you just gave him reason to believe you might have illegal drugs or parapharnalia. If you're stupid enough to not throw the joint out the window I guess you had it coming.

only if they ask you and you are stupid enough to say yes. fourth ammendment protects us from illegal search and seizures.They also have to list what they are looking for and where they are going to search. Ex: If they are looking for a car or something that would normally be found in a garage..........they cannot legally search your house claiming to search for these items unless you give them permission to do so.

Yes it is.
For instance, if you have an alcohol license the abc officers can search whenever and for whatever they want. There are other instances as well.... search incident to arrest, etc.

no under the 4th amendment in the bill of rights it states no unwanted serches or seisures that means they neeed a search warrent or they be in trouble
