Daughter had bathing suit top taken off against her will in a public place. Not as a joke, even if it was it isn't funny. Many had conspired to make the boys do this. My daughter ran away covering breasts in tears. Please help me with legal terminology that I can present to parents of kids responsible.

This sucks!! The cops said they can't and won't do anything. They can't unless they were 14 years old. I'm soooo angry right now. I guess the girls that have been bullying her and conspired to humiliate her today win again. This is crap. It's pretty bad, when I want to beatup a bunch of 6th graders. (I won't! I'm just venting!!!)

How old is your daughter? And how old were the boys who did it? If they are ALL minors, you probably have no legal action. Sorry. Just talk with the parents and make sure they talk with their kids so it doesn't happen again.
If one of the boys was an adult and your daughter isn't, then there is a real problem, and you could have him arrested for sexual assault on a minor.

At the very least, it's assault and battery. In some jurisdictions it would be classified as sexual assault and sexual battery, a considerably more serious crime.
An assault is the motions towards a person giving them rational rise to fear or expect unwanted physical contact. Battery is when that motion results in physical contact, no matter how minor.
Sexual harrassment might be a lesser included offense, but there is clearly an assault and battery here at the very least.
The conspirators are guilty of conspiracy to commit assault and battery or conspiracy to commit sexual assault and sexual battery. In most jurisdictions conspirators get the same punishment as the perpetrator(s) of the crime(s).
You should seriously consider pressing charges against these hooligans. ALL of them! With something this serious, I would NOT be speaking to the parents especially since some would try to provide an alibi for their children. It's not right, but it happens all the time.

Talk to the prosecuting attorney's office. Do accept "no" for an answer.
Here are some things to bear in mind:
Your daughter has as much right to the protection of law at age 12 as someone that is older.
The girls that instigated this assault, are also guilty and need to be held accountable, otherwise they are likely to continue.
The police officer that you spoke with should be held accountable for the B.S. answer that you were given.

CALL the police!!!!!!!!!!!!!!! Don't discuss this with the parents of the offenders. Obviously they haven't taught their children to respect another's body. They are going to pass it off as "BOYS WILL BE BOYS". If you come at them with just some legal jargon and that's it , trust me, they'll blow you off as blowing this way out of proportion.
Talk to your daughter and explain to her why you have to do this. She will probably want this to all just go away. But if those boys get away with something like this now, they will only try more and worse later on. Next time it maybe more than just the bathing suit top and it maybe more than taking it off. I'll bet you anything they also groped her and she maybe too embarrassed to tell you. Support her and tell her to be strong. Those boys need to learn NOW that a person's body is off limits.

I would involve the police because those boys need a good scare. It falls under sexual harrassment or maybe even assault depending on how they did it. Even if you don't want the police to respond, I would call them and open a file just in case something like this happens again.

That I believe would be considered Assault. I would go to the the parents of the one that did this to her, I would go to the Police Department and file charges against the one responsible and let the police go to the parents. If someone had done that to my daughter, I'd be so mad there's no telling what I may do. I'm so sorry that happened to your child.

You should check the statutes in your state. It could be assault, it could even be sexual assault. It could be something else. For example, in NJ I found the following:

Assault. You may be able to take a Juvenile Petition against the juveniles that actually removed her top, and subpeona the others involved. Call your local District Attorney General's office for advise, as they will be the prosecutors.

get the police involved. that way the kids and parents know you are not kidding about the allegations. something needs to be done to stop these boys from acting stupid again. there are always parents that deny and will tell you that their son wouldn't do that.just let the police hand this problem.
