My son received an RE-4 discharge when he had a nervous breakdown because his wife stopped paying rent on their apartment and took everything they owned, and disappeared with another man, while Sonny was at sea on an aircraft carrier.

Now he is having trouble getting a job because of that. Can you help us?

Please dont go to the JAG - they will look at you funny. Once the discharge is executed they play no part in the determination of any "upgrade."

There are two places you can petition to have the discharge characterization (or whatever RE-4 is). In the Air Force, the first stop is the Air Force Discharge Review Board.

The BCMR (Board of Corrections for Military Records) is also a "second chance" Please see links below. A civilian attorney familiar with this process will be extremely helpful.

ALSO - "The Armed Forces Disciplinary Control Board" has nothing to do with discharges - dont waste time researching that.

You will need his service record, or copies and then see the Judge Advocate General of his service or the nearest military base for a hearing. The JAG may either uphold the ranking or upgrade to one more suitable, based upon what he finds in your sons records and how your boy is today. He may also require a doctors evaluation.

He will have to apply to the Armed Forces Disciplanary Control Board if he was chaptered for anything other than medical. If he recieved a medical discharge.... then the application begins with the Department of Veterans Affairs.
