A family member borrowed money in another family member's name and is not re-paying it. Now the other family member needs to re-fi house and the lack of payment is really hurting the loan process. However, some family member's are still very friendly with the offender and this makes for a lot of hurt feelings.

Tough spot ... you could report this mis-use of credit to the credit burrows ... but this only ties matters up further ... however, I feel that family members have MORE responsibility to legally hold each other accountable than strangers (who ironically treat each other better) ... this is a major problem with today's society ... we're afraid of hurting each other and neglect to hold our loved ones in responsible positions ... if we'd start holding family members accountable for their actions, and the learned to be accountable, then society is better!!!

I guess the treat of telling the officials and charging jail time might make the other family member pay up, but I doubt it ... once a sponge, always a sponge ......... plus, they probably understand that the legal process still ties up the "Re-Fi" process ...

If you feel you must take the legal road ... once you start, there is no turning back so you have to prosecute all the way (there's no half pregnant attitude).

take him to court and make him pay.
