no, they can only run a background for a valid investigation, or on a traffic stop. Personal use of the NCIC equipment for personal use is restricted by law. The dispatcher that runs the check and/or the officer who does it can get into serious trouble including losing thier job.

Of course not. Every government agency, local, state or Federal, has regulations about this. Your problem is "how do I prove this was done?" I worked for a law enforcement agency. Every criminal inquiry was logged by the server, and any law officer or analyst with access could be asked "what case were you researching?" "Why did you look up Fred Jones and his personal history?" If no case and no case file existed, the officer was in trouble. You need to see a lawyer, though, if you suspect the SC police captain has done this or will do it. Your lawyer will know what to do.

It is illegal if they are using the NICI system to look up imfomation for thier own use or non official use. If they want to request a back gound off the internet or pay for one from the Police department, thats not illegal. Anyone can request a background for any one.

Its not legal and its not ethical but they do it all the time. I used to date a police officer and hung out with a lot of them... they all said they did it and especially if they were dating someone and they wanted to do a criminal check. Nice huh, but they have the power and what can you do about it?

yes, it is legal: as of new supreme court rulings, the supreme court has now ruled that no knock warrants can be issued, where the police can eneter a home or building without knocking, and infoirming the person, or persons inside who they are.

The supreme court has also ruled that Police can pick up anyone, and hold them for a period of 48 hours, if the police even think that a person may have a committed a crime.

sure, and depending what state and what info your looking for you can too, there is usually a fee. Oh, and you get it from the police dep. Now I pretty sure selling the info to the highest paying buyer is illegal. but just looking it up? yeah.
