How does she KNOW who took it? Did the police investigate? Has the BK employee been arrested? If so, then the courts may hold the BK employee liable for reimbursing you IF the employee is found guilty. But your odds of collecting from an individual are slim.

If your Mom reported the loss of the debit card to her bank, she should NOT be held liable for any charges beyond the first $50.

She could sue the BK chain owner in small claims court to recover the lost funds, but she would have a hard time proving intent -- the BK chain owner probably did not knowingly allow the employee to steal or use the card.

The only way she can sue BK is to implicate their policy in the theft. What is their policy regarding items left at the cashier? I assume that is how the employee got possession. Was company policy followed. If so you are SOL. If not then dig further and find out where the policy allowed the employee to access the card. Then you may have a case.

Your mother will not be held liable by the bank, if she claims that hte card was stolen. She can sue both the worker and the individual BK owner (franchisee) if she would like. However, suing the franchisee is punishing the wrong person... she needs to go after the person she has PROOF of stealing and charging the card.

As others have reported: you are able to sue absolutely everyone for some thing, triumphing in court is yet another remember, even if. i'd propose that your mom locate that manager of the area in question and communicate with him/her. If the governmentdoesn't make sure it right away, you pick to make sure who owns the franchise (the call is frequently revealed in some conspicuous position contained in the eating position). If the owner refuses to unravel it to her delight, bypass to a criminal professional. it should be peanuts in words of the wider attitude, yet in case you sue the BK franchise, they might settle out of court and provide you more effective than the three hundred. The criminal professional would probable fee you that contained in the fist hour or 2. yet once you've a good case, the criminal professional ought to get BK to pay his value plus yours. BK does have duty, assuming the cardboard became stolen out of your mom at the same time as she placed an order at BK. they could garnish the wages of the worker to get her three hundred decrease back, in the journey that they don't pick to objective this and in simple terms wish you bypass away, then it serves them precise to ought to pay your criminal professional's prices on proper of the three hundred. through taking both steps above, you attempt to remedy this quite with out greed. If BK in simple terms ignores you, then prepare them a lesson in shopper etiquette. And in simple terms an FYI to those available who imagine that BK has no duty for this action, if an worker places floor glass contained in the food, the eating position the position s/he works will be held in charge in a civil court because they have the duty to employ workers who're no longer risky. it really is why maximum human beings ought to submit to criminal history checks previously getting a job. awaken human beings, and stay contained in the actual international!

Your mother should be reimbursed by the bank. I don't believe that she can sue Burger King unless she found a finger in her Whopper.

no she can't sue the company. the employee who stole it has to have charges of theft laid before them and then he/she takes sole responsibility. the company as a whole didn't participate, or even know about ir, for that fact.
