What specific federal (or state) law or laws could be violated from unauthorized retreiving of e-mail, through a password obtained without the user's permission?

Unauthorized retrieval of anyone's email violates their privacy. The federal wiretapping law (18 U.S.C.A. § 2518) would be implicated. There are both criminal (prison) and civil (monetary) penalties for violation of the statute. There are many exceptions to the privacy of email - most notably employers (most employers have the "right" to monitor your email and computer use from their computers.) But there is not a marital exception for email - if a spouse has a separate email account, that is protected and private from his/her spouse - especially when there is a password that has not been covertly shared.

Why would you want to read your spouses e-mails? The mail box doesn't know who is checking ti just as long as you have a password, but I would imagine that your spouse would be very upset if they found out that your reading they're mail. I really don't know if there's a law that prevents you from reading their mail but if you do things involving a bank then it's federal.

I don't know about the legal side but it would spell the end of the marriage/relationship. Relationships are based on love, trust and honesty. By doing the above you would successfully kill the trust and be dishonest.

Er, im not American so i wouldnt know about you guys, but over here its privacy laws. Complete breach of confidentiality.
