I dated my girlfriend for a year and a half, and we've lived together for six months. I initiated the break-up, so I'm leaving, she keeps the apartment. She says I need to keep paying my half, since we both agred to it when we entered the lease. How do we decide who gets common property...I'm mostly concerned about friends. Do I need to give back the Yankees season tickets she gave me for my birthday?

the tickets were a gift so no - you keep those

if they are true friends then they should be able to be friends with the both of you. there is no way to "split" them up.

As for the apt. I'm sorry but it is only fair since you are on the lease. It isn't fair to dump her and leave her the hefty payment. At least till maybe she can find a roommate or something if that is possible. Either that or if you can convince her to move out to a cheaper apt. just pay until she moves.

This could be a bigger problem than you might suspect. You might wish to consult a lawyer, because in some states, it is still in the books that if you live with a woman for 6 months, or in another way present yourself as husband & wife (such as by signing into a hotel as Mr. & Mrs.), you are common-law married. In this particular case, you would need to get a divorce or annulment, especially if you were planning on marrying in the future, because you could be charged with polygamy if you don't. A lawyer could also tell you if you are contractually obligated to pay your half of the rent. As for the season tickets, those would most likely be considered a gift, & you would not be required to return them. Good luck.

You don't have to pay 1/2 the lease unless you break the lease and then you should pay for half the penalty...as far as gifts I have to say those are your and hers to keep and should not be considered in common property value consideration...that can be distributed by sets...you get bedroom , I get living room ..we split kitchen and so on...break-ups are never easy....one or the other are going to want to argue for argument sake about something petty...try not to play into such a game..good luck.

No way the tickets were a gift, and I bet in court they will tell you the same. Be mature about it all, even if she acts like a b i t c h, thats the best way to protect yourself. Also, I think its messed up that she is trying to make you pay your half of the rent - are you even living there? Give me a break - she is manipulating you, no wonder you wanted to break up with her! Those kind of girls are so annoying and selfish. I may be wrong but I think legally you are not required to pay if you have moved out - as long as you have proof that you are living somewhere else. Your girl sounds kinda psyhco and immature.

If she keeps the apartment, let HER pay the rent. Who's name is on the lease? If both of your names, then you ARE still legally responsible...

I'd keep the tickets, and pay rent on the apartment until she can find another roomate, and if that doesn't work out, u should give her back the yankee tickets. I don't like to keep stuff that my ex's gave to me.

You don't have to give back a gift. If she insists on you giving them back, pick something you gave her, which she won't let you take back and tell her to give that back. About the rent, you broke up with her, so I think it's fair that you pay part of the rent. She is probably very sad and angry, so try to help her.

If it was a gift u do NOT have to give them back!!! Who'd wanna give back YANKEEE tickets!?

You don't have to pay ur half if ur not living there...unless ur name is on the lease...then u may have a problem.
