Oh, baby. There was a lawsuit over this issue several years ago in San Jose, California. The bamboo went crazy and grew under the owners driveway and tore up his neighbors garage and driveway. It was really a battle and it is really hard to kill once it takes over. Go on the Internet and print out some nightmare stories and take them to your neighbor. Then tell him calmly what your concerns are so he can make an intelligent decision. Good luck!

Unless the bamboo is blocking your view when exiting your driveway, there is no legal action. Your state highway department would take care of the overgrown bamboo to make your driveway safe for you. If the plants are growing onto your property, it is your legal right to destroy those plants.

There's no legal action. It's on his property, and you can't make him do anything he doesn't want to do. But, as in the case of trees, you can trim whatever is growing into your yard (i.e., over on your side of the fence) as long as you don't damage the plant/tree in the trimming process.

What's in his yard is in his yard.
What's in (or hangs over) your yard if yours.
If your neighbor had a large tree with limbs hanging over your driveway - if a limb fell on your car, even though the tree is in your neighbors yard, that limb was over your property - you can cut it up to the property line.
It's always nice when your neighbor takes responsibility for what they've created - but it doesn't always work like that.

You've probably got no legal rights unless it grows over to your property or you live in some sort of community that has rules and bamboo tree is against them.

If it's extending onto your property line you probably have the right to cut that portion of it. Check with your local zoning office. Most towns have a zoning enforcement officer also who can probably help by speaking to the neighbor. But my guess is that if you cut what's over your property line he will probably not even notice. But if you think he might have a fit if he notices, contact the zoning people.

If it's totally on your neighbor's property, there is nothing you can do, unless you live in a subdivision with covenants against it. Check your covenants, and if there is a rule against it contact your Homeowners' Association to take action.

If it is over you sid of the property line, then you need to ask him once more and if he doesn't comply, then you may take legal action. I'd say talk to the police and ask them to help you figure out the solution.Good luck!!!
