I was married in April and applied for immigration. My attorney says that it probably won't be approved until 12/06. Will I have a problem at customs when I fly to Canada at the end of this month with my children. What should I say. I will not be returning to the US until the paperwork is approved. My husband is currently in Canada. Thanks

More Details .... My husband is canadian, I am american. I am just wondering what do I tell customs. (if my citizenship isn't approved at the end of the time then we will got back to the states but I do not foresee that happening). Do I just say we are here for a month on vacation ?

Not Enough information here, Did your Husband sponsor you? What is his staus in Canada? What visa are you using to go to Canada? Why cant you wait till 12/06?

Which paper work are you doing? Is your spouse sponsoring you? If so, which sponsorship papers have you filled out? Are you submitting paperwork from while you live in Canada or are you submitting paperwork while you are living in the US.

Are you still in the US and submitted paperwork to your husband in Canada? If so you should only be going to Canada to visit, not to stay. As your paperwork will be looked at in Mississauga and then go to the nearest visa office in the US.

If you submitted paperwork while you were in Canada, then you really shouldn't have gone back to the US. As the more often you leave and come back, the likelyhood of them denying you entry may become possible. The Border can dictate how long you can stay in the country. For you to assume that the border will just let you stay as long as you want is wrong and you might be putting your paper work in jeopardy. And for your attorney not to say anything about whether you should stay or not is irresponsible on his/her part.

As for kids, if the kids are not your husbands kids you should have a legal document from their biological father stating they can leave the country. Also, if your current husband is sponsoring your kids they have to be declared on the documentation. And everything has to be done for them as well.

I would seriously ask your attorney if what you are doing is correct and will not jeopardize your application. If not, don't be surprised if you get denied in any part of the process.

Sorry to throw that at you but I am currently in this exact process with my husband coming from the US.

You can stay in Canada for six months on a visitor's visa, but you have to leave at the end of that time. You may have a problem with the children -- is your husband their father, or has he adopted them? If not, he may have difficulties in sponsoring them.
You really can't say you will not be returning to the US until your paperwork is approved, as you will HAVE to return if your visa expires before them. If you don't you will create huge problems for yourelf in trying to immigrate.
