Yes. Was the accident reported, was a cop there, did you notify your insurance company? Consult with an attorney.

If you can handle it with an adjuster, I would. As long as they seem fair. Keep in mind that by getting a lawyer, you may get more money, but lawyers fees can be steep. After paying your lawyer you will probably end up with about the same amount of money. But you need your medical bills paid and some one to watch out for your best interests. Find a lawyer who gives free consultations and see what he has to say.

How long ago was this? Is there a police report?
Get to a good personal injury lawyer as fast as you can. Unless you are retired or were handicapped before the accident (not earning an income), you should not have a problem finding a lawyer to take this case on a contingent fee basis.

You have already been too long without legal representation.
IMMEDIATELY contact a "personal injury" attorney.
DO NOT SIGN ANYTHING from the insurance company, or anyone else accepting any kind fo a settlement.
DO NOT GIVE THE INSURANCE COMPANY A DETAILED INTERVIEW ABOUT THE ACCIDENT.
To find a reputable attorney, call your local chapter - or the state offices of - the Trial Lawyers Association for your state. They will give you 5 members in good standing who have professional specialty qualification in personal injury law.
DON'T SIT AROUND WAITING - get moving!
And the best of luck!

If you feel they are offering a fair settlement and are paying for ALL of you expenses from the accident, a lawyer would be a waste of money. If the insurance company is trying to screw you over, a lawyer would make sense.

I'd probably get a lawyer. First of all, what he did was illegal, and it caused major injuries to you, as well as that it totaled you car. Did you happen to get the license plate and name of the driver?

I hope you filed a police report immediately. If not, you need to do so.
The second step is probably to get a lawyer. Chances are his insurance company will do everything they can to avoid paying your medical bills, etc.
