I have the title, which is signed by both the seller and myself, but I haven't had the title changed over. This is why they want to take the vehicle. Can they do that?

They can not take the car from you. Whatever you do, do not give up possession of the vehicle. Because legal ownership of the vehicle is not clear (because you have not transferred the title), the only way they can take the car is through civil litigation assuming they have a case. If you give it up, the only way you can get it back is the same way - unless you have clear proof of ownership. This can be done by completing the transfer of ownership into your name. If there is any grey area as far as ownership, possession of the vehicle means everything. Keep it locked in your garage until you complete the transfer if you have to, but do not let them have the opportunity to take the car. Once you have transferred the title, if they take the car - it will be considered auto THEFT and the police must recover the car for you. Hurry up!

When you and the seller signed the title, I hope you had it Notarized as well. Take it to your DMV, and get it titled to you. The State does not recognize this as your car, until you get it titled to yourself.

Do it today. You should have done this immediately, I hope it's not too late for you now. But be sure - if the title is still in the other person's name - the other person can do whatever they want with it.

The title you hold is the original ,any duplicate title is subject to and superceded by the original title; the original when produced as long as the title is signed and dated by both parties and sellers name and signiture match is a binding document of the sale to you the new purchaser of the vehicle.You have to transfer it to complete the sale and a new title will come back to you .(if you are woried you will not get it delivered to you in the mail send all your mail to a temporary post office box that way it will be a guaraunty of delivery and piec of mind )
I do strongly suggest that you re-title it in your name to stop this problem .and if you have proof of payment have that with you as well when you go to the DMV ,you do not have to plate a vehicle to own it .but it would stop this problem you are having with the seller . good luck to you !

No, they can't. However, to perfect your title, you MUST get it transferred IMMEDIATELY. In most states, you are REQUIRED by law to transfer the title and registration to your name within 30 days of acquiring the vehicle. There may be fines and penalties if more than 30 days have elapsed since you purchased the vehicle.

How long has this been going on? When did you acquire the vehicle? And why did you not transfer the title when you bought it?

yes. they can do that. the title you have is no good according to the law. the other person can take the car from you and you can do nothing about it unless you get the title transfered on your name.
