I need a sample of his blood to be able to do a DNA test to prove that he is the father for legal reasons. Does anyone know if I need to hire a lawyer? or if I can request it personally from the crime lab? I am so upset and stressed about his death and on top of everything, I am not getting straight answers fromt he police and sheriffs. First why would the crime lab be involved in a motorcycle accident, most likely the body went straight to hospitial to be declared dead and then off to the funeral home for processing.

And by the time you read these answers most likley the funeral will be over.

You will have to hire an attorney, who will file a motion to prove if he was the father or not. His estate can fight the motion if they want to.

Of course you will also be responsbile for paying for all of the DNA testing.

Move quickly and don't run your mouth about it. There are cases that a family has cremated the father.
You need to get a lawyer or legal aid to arrange for the test. There are times that courts will take too long and there is a messy court order to test the father's parents or siblings. The worse case scenario is to have the medical examiner to exhume the body; then it hits the news papers.
Surely you have a tooth brush or a comb that belonged to the baby's father. Being intimate means there should be something that holds DNA.

You need to contact legal aid in your town immediately. Even if the body was embalmed DNA testing can still be done. It is easier to do this without having to exhume the body (i.e. dig up the grave)... and if he is cremated it will be harder to prove, but not impossible.

If he is on the birth certificate that is all you need. You are not going to be able to get DNA testing done, by now they have done and autopsy and embalmed him and preparing him for either burial or cremation. It would take a court order or permission from his parents to get any of his DNA

do you need to prove he is the father so the child can draw his social security? Because if that is the case, all you need is for one of his parents to go to SS office and say that their son is the childs father. I know this is so because my niece did this.

would could get a felony specialist in this one...I dont imagine the crime lab would do a dna pattern for merely that.....i imagine for some thing like this it must be courtroom ordered.....reliable success!
