you are definately being brought up on charges because A) you were driving drunk and B) caused an accident. the cop may or may not be brought up on charges because they did not hit you and there's no proof that he was "driving" at the time.

he SHOULD be brought up on charges for being intoxicated behind the wheel, but unfortunately that little badge that cops carry tends to be a "get out of jail - free" card. That's just the way it goes...

You are the one who was drunk and crashed into his car. You will definitely go to jail. But, if the cop was drunk and driving (irrelevant whether he is off or on duty). He will be going to jail too. But you get more fines and the fault of the accident will be yours and your insurance will pay for all the damage caused.

Both of you go to jail. Insurance coverage, is a different story - your fault means your insurance will pay for the damage you cause to the drunk cop's car but will not pay for your vehicle or you. That means no ambulance coverage, no medical coverage, no new car, zippo, nada, zilch. But you'll be in jail, so I think you won't need a car and you'll get free health care. How cool is that?

Trick question? If you crash into the cop (sober or drunk) you'll get a ticket. If you're drunk, you'll get another ticket. The cop will go home and watch you on the ten o'clock news.

If it happened in the UK then neither of you would, because UK (and probably several other countries) are extremely soft on criminals. I seen a thing on the news yesterday where a guy got life in prison, and ended up serving something like just 6 years before they released him. And most criminals don`t even get jail sentences.

I like to think you wouldn't be so stupid as to do something like that. Also, I like to think cop don't drink on duty, but here in Kansas evidence (moonshine, especially) does go missing and cops are only human beings (believe it or not)!!!

it probably depends on whose fault the accident was.. .well actually if both of u were drunk you would both go to jail. lol
