Actually visitation isn't REQUIRED completely at all, there are certain circumstances in which the child doesn't have to, one being if they dont' want to visit, they can simply tell the parent that and choose not to go and the court will not intervene. Second, if there is imenant danger present or the home is unfit, they also do not have to go. Best thing you can do is what you have already done, however the lawyer should be able to tell you all of this, if the lawyer has not done so, you've hired a less than adequate attornery. People having sex or engagin any sort of sexually explicit conduct in front of your child will reult in the his losing visitation and possibly being charged with neglect. Ask her if she wants to stay home, if she doesn't want to return to see her father then keep your child at home and have her continualy notify your ex she doesn't want to visit. The court doesn't REQUIRE you to make her visit, it actually requires that your ex be given the opportunity so long as your daughter agrees or wants to go. The worst that may come of it would be supervised visitation which you can obtain by emergency rather than waiting for court and you can also be granted emergency full unconditional custody. Your lawyer should have advised you of that also.

Don't let your daughter go to her father's again. She's being damaged by the stuff she's having to deal with. Do you have a lawyer of your own? Don't settle for sending a letter to the court. Get a lawyer on your side to fight for you and your daughter. If you have no money there are legal clinics that do this sort of thing pro bono (for free).
I would also suggest notifying CPS (child protective services) in your area and alterting them to what your husband and his girlfrined are doing. He needs to be labelled an "unfit parent" and never have unsupervised visits with your daughter again.
I hope you can get this dealt with quickly. Please, don't wait around for bureaucrats in the court to get around to reading your letter. Get a lawyer. Get a pushy lawyer.

If this activity is going on there must be some kind of action you can take. The law would not just stand by while your daughter is being submitted to this sexual abuse. Talk to local law enforcement or to your lawyer. The fact that your daughter is witnessing these happenings is illegal on the part of her father and the others in the house. Particularly on the part of the father because he is exposing himself to young people.

I don't understand why the court is still making her go see her father??? they really shouldn't....its awful what that man does in front of his daughter! you're doing the right thing by having an attorney....you're doing all the right things....just try and talk to your daughter about what she saw and try to explain it to her...i guess you have a counselor, but as a mother, try to be there for her.....hang on.....i hope that guy never sees her again....

Terrible. He is the worst possible father. Keep her away from him at all costs. I hope that the court is sympathetic to your situation.

So far, you've done all the right things. If you have to, make excuses to your ex, telling him that your daughter has the flu- just do whatever you can to keep her safe.
